These Terms and Conditions (“Terms”) govern all individuals and groups (“Photographers,” “Guests,” or “Users”) who schedule or use Pioneer Trails Tree Farm (“we,” “our,” or “us”) for photography purposes, including professional photographers, hobbyists, content creators, and guests taking personal photos.

By booking a photography session, entering the property for photography purposes, or using our facilities for photography, you agree to these Terms.

1. Permission to Use Property for Photography

Photography on Pioneer Trails Tree Farm is permitted only with prior approval or scheduling, unless otherwise stated for general admission areas.

We may grant access for:

• Professional photography sessions
• Amateur or personal photography
• Seasonal or holiday photo sessions
• Content creation (social media, portfolios, etc.)

We reserve the right to approve, deny, or limit photography access at our discretion.

2. Scheduling and Fees

• Photography sessions may require advance scheduling
• Fees may apply for professional or commercial use of the property
• Time limits may be enforced to ensure fair access for all users
• Arrival and departure times must be respected

Failure to comply may result in cancellation of current or future privileges.

3. Property Use Rules

All photographers and guests agree to:

• Stay within approved photography areas only
• Avoid blocking walkways, entrances, or customer areas
• Not damage trees, crops, props, fences, or equipment
• Follow all staff instructions at all times
• Clean up after themselves and remove all equipment

Tripods, props, lighting, and staging must not create hazards or disrupt farm operations.

4. Public Access and Other Guests

Pioneer Trails Tree Farm remains open to the public during certain hours and seasons.

Photographers acknowledge that:

• Other guests may be present during sessions
• Exclusive access is not guaranteed unless specifically arranged
• Cooperation and respectful sharing of space is required

We are not responsible for interruptions caused by normal farm activity or public visitors.

5. Weather and Conditions

Outdoor photography is subject to weather and natural conditions.

We may:

• Reschedule sessions due to unsafe conditions
• Restrict access to certain areas
• Close parts of the property without notice for safety or maintenance

No guarantees are made regarding lighting, scenery, or environmental conditions.

6. Commercial Photography

Commercial use includes but is not limited to:

• Brand shoots
• Advertising content
• Paid influencer work
• Product photography

Commercial photographers may be required to:

• Obtain written permission
• Pay additional fees
• Provide proof of insurance (if requested)

7. Equipment and Liability

Photographers are responsible for their own equipment.

We are not liable for:

• Loss, theft, or damage of personal equipment
• Injuries resulting from equipment use
• Accidents caused by misuse of property or unsafe setups

8. Conduct and Safety

All users must:

• Act respectfully toward staff, guests, and other photographers
• Supervise children, clients, and assistants at all times
• Avoid unsafe or disruptive behavior

We reserve the right to end any session immediately if rules are violated.

9. Communication and SMS Consent

We may communicate with photographers and guests via phone, text message, or email regarding scheduling, appointments, weather updates, policy reminders, access instructions, customer support, and photography-related services.

By opting in, you agree to receive customer care and booking-related text messages from Pioneer Trails Photography Department, including appointment confirmations, updates, reminders, and service notifications.

Message frequency varies based on your interactions and scheduled services. Message and data rates may apply.

10. Termination of Access

We may update these Terms at any time. Continued use of the property for photography indicates acceptance of the updated Terms.

12. Messaging Terms and Conditions

Pioneer Trails Tree Farm Messaging Terms and Conditions

The messaging program consists of customer care and appointment-related text messaging used for photography booking confirmations, scheduling updates, appointment reminders, weather notifications, customer support, and related photography service communications.

By opting into our messaging service, you consent to receive SMS messages from Pioneer Trails Photography Department at the phone number you provide.

Message frequency varies based on customer interactions, appointments, and service requests. Message and data rates may apply.

You may opt out of SMS communications at any time by replying STOP or UNSUBSCRIBE to any message received from us. After sending STOP, you will receive a confirmation message and will no longer receive SMS communications unless you opt in again.
